This action is part of a larger push to widen the homefront role of the armed forces in several urban centers under Democratic control.

Court Fight Over Troop Deployment

In an emergency filing, the US Department of Justice urged the bench to set aside a previous judicial decision that had blocked the sending of hundreds of state guard personnel to the Chicago area.

The district judge had voiced concerns about the administration's justification for deploying forces, challenging its explanation in considering the situation on the ground.

A higher court affirmed the initial ruling on Thursday, keeping the deployment on pause while the legal challenge continues.

Government's Justifications

The solicitor general, representing the administration, stated in the recent request that government officers have often been “menaced and targeted” in Chicago and the outlying area of Broadview.

This site is home to an Immigration and Customs Enforcement detention center.

The president has earlier sent state guard forces to the Windy City and Portland, subsequent to earlier activations to LA, Memphis, and the nation's capital.

The White House has argued that troop deployment is needed to control demonstrations and support deportation efforts.

Partisan Resistance

Elected Democrats have pushed back sharply the move, arguing that the president’s claims are inflated and driven by politics.

They accuse the former president of misusing his power to punish opponents.

Court officials have also expressed doubt about the government's portrayal of events.

City officials state that demonstrations over ICE activities have been mostly modest and non-violent, challenging the administration's portrayal of “war zone” situations.

Statutory Grounds

At the heart of the conflict is the administration's application of a national law allowing the commander-in-chief to nationalize the state guard only in instances of uprising or when “powerless with the federal troops to enforce the laws of the nation”.

The White House argues that the forces are required to protect US facilities and officers from protesters.

Latest Developments

Previously, the administration took control of 300 members of the Illinois national guard and ordered extra guard from Texas personnel into the state.

As city officials denounced the action, the former president increased his statements, calling on the arrest of Chicago’s mayor and the state's chief executive, each a Democrat, accusing them of failing to secure ICE personnel.

The state of Illinois and municipal government filed a combined lawsuit the government to block the deployment.

On 9 October, the presiding federal judge, a Biden appointee, delivered a preliminary order blocking the command.
